Terms & Conditions – Fly Reclaim

These Terms and Conditions (“Terms”) apply to the services offered by Fly Reclaim FZC (“Fly Reclaim”, “we”, “us”, “our”), a company registered in the United Arab Emirates. By signing the Assignment Form or submitting a claim via our website, you agree to be bound by these Terms.

1. Definitions

  • “Fly Reclaim”: Fly Reclaim FZC, Business Centre,Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.
  • “Client” / “You”: the passenger assigning the Claim to Fly Reclaim.
  • “Claim”: any demand for compensation, damages, or reimbursement arising under Regulation (EC) 261/2004, UK261, the Montreal Convention 1999, or other applicable passenger rights laws.
  • “Assignment Form”: the document signed by the Client transferring ownership of the Claim to Fly Reclaim, or alternatively granting Power of Attorney if assignment is invalid.
  • “Fee”: Fly Reclaim’s service fee, equal to 30% (VAT included) of any recovered compensation.
 

2. Scope of Services

  • Fly Reclaim provides claim management services for flight disruptions, including delays, cancellations, denied boarding, missed connections, and baggage issues.
  • We handle all steps of the claim process: eligibility verification, communication with airlines, negotiation, legal escalation, and collection of compensation.
  • We may cooperate with partner law firms or third-party agents to pursue claims.
 

3. Assignment of Claim / Power of Attorney

  • By signing the Assignment Form, you transfer legal title of the Claim to Fly Reclaim (Assignment).
  • If assignment is invalid, the Assignment Form acts as a Power of Attorney, authorizing Fly Reclaim to represent you exclusively in all dealings with airlines, courts, and authorities.
  • Once the Claim has been assigned, you may not pursue the claim directly or via another agent.
  • Any compensation paid directly to you is deemed held in trust for Fly Reclaim, and our Fee remains payable.
 

4. Client Obligations

  • Provide complete and truthful information and documentation (tickets, boarding passes, receipts, ID where required).
  • Refrain from pursuing the Claim with the airline, another company, or a lawyer while Fly Reclaim is engaged.
  • Immediately inform Fly Reclaim if you receive any payment or communication from the airline relating to the Claim.
 

5. Fees

  • Our service is strictly no win, no fee.
  • If no compensation is recovered, no Fee is due.
  • If compensation is recovered, Fly Reclaim charges 30% (VAT included) of the total recovered amount.
  • If compensation is paid directly to you, you remain liable to pay Fly Reclaim the agreed Fee.
 

6. Legal Proceedings

  • Fly Reclaim may escalate claims to courts, regulators, or enforcement authorities if necessary.
  • You agree to cooperate by signing additional documents (including Power of Attorney) if required for litigation.
  • Fly Reclaim covers all litigation costs, unless you unilaterally withdraw or settle directly with the airline—in which case the Fee remains payable.
 

7. Limitation of Liability

  • Fly Reclaim will act diligently but does not guarantee successful recovery.
  • We are not liable for indirect or consequential losses (missed holidays, lost time, emotional distress).
  • Our liability is limited to the total Fee paid for the specific Claim.
 

8. Data Protection

  • We process your personal data in accordance with our Privacy Policy, compliant with UAE PDPL, EU GDPR, and UK GDPR.
  • Data may be shared with airlines, legal representatives, courts, and service providers solely for claim purposes.
  • Sensitive data (e.g., disability or medical information) is processed only when necessary to support your claim.
 

9. Termination

  • You may withdraw before signing the Assignment Form without cost.
  • Once assigned, termination is only possible by written agreement.
  • If you withdraw unilaterally after Fly Reclaim has initiated work, or if you settle directly with the airline, our Fee remains payable.
 

10. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the United Arab Emirates, without prejudice to mandatory consumer protection laws in your country of residence.
  • Disputes not resolved amicably shall be subject to the jurisdiction of the Dubai International Financial Centre (DIFC) Courts, unless mandatory local law applies.
 

11. Miscellaneous

  • Fly Reclaim may amend these Terms from time to time. Updated Terms will be published on our website with a new effective date.
  • If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.
  • In the event of conflict between these Terms and the Assignment Form, the Assignment Form prevails regarding assignment and representation.
