Terms & Conditions \u2013 Fly Reclaim<\/b><\/h2>\n

Last updated: September 2, 2025<\/b><\/p>\n

These Terms and Conditions (\u201cTerms\u201d) apply to the services offered by Fly Reclaim FZC (\u201cFly Reclaim\u201d, \u201cwe\u201d, \u201cus\u201d, \u201cour\u201d), a company registered in the United Arab Emirates. By signing the Assignment Form<\/b> or submitting a claim via our website, you agree to be bound by these Terms.<\/span><\/p>\n

1. Definitions<\/b><\/h3>\n
    \n
  • \u201cFly Reclaim\u201d<\/b>: Fly Reclaim FZC, Business Centre,Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.<\/li>\n
  • \u201cClient\u201d \/ \u201cYou\u201d<\/b>: the passenger assigning the Claim to Fly Reclaim.<\/span><\/li>\n
  • \u201cClaim\u201d<\/b>: any demand for compensation, damages, or reimbursement arising under Regulation (EC) 261\/2004, UK261, the Montreal Convention 1999, or other applicable passenger rights laws.<\/span><\/li>\n
  • \u201cAssignment Form\u201d<\/b>: the document signed by the Client transferring ownership of the Claim to Fly Reclaim, or alternatively granting Power of Attorney if assignment is invalid.<\/span><\/li>\n
  • \u201cFee\u201d<\/b>: Fly Reclaim\u2019s service fee, equal to <\/span>30% (VAT included)<\/b> of any recovered compensation.<\/span><\/li>\n<\/ul>\n

    2. Scope of Services<\/b><\/h3>\n
      \n
    • Fly Reclaim provides claim management services for flight disruptions, including delays, cancellations, denied boarding, missed connections, and baggage issues.<\/span><\/li>\n
    • We handle all steps of the claim process: eligibility verification, communication with airlines, negotiation, legal escalation, and collection of compensation.<\/span><\/li>\n
    • We may cooperate with partner law firms or third-party agents to pursue claims.<\/span><\/li>\n<\/ul>\n

      3. Assignment of Claim \/ Power of Attorney<\/b><\/h3>\n
        \n
      • By signing the Assignment Form, you <\/span>transfer legal title of the Claim<\/b> to Fly Reclaim (Assignment).<\/span><\/li>\n
      • If assignment is invalid, the Assignment Form acts as a <\/span>Power of Attorney<\/b>, authorizing Fly Reclaim to represent you exclusively in all dealings with airlines, courts, and authorities.<\/span><\/li>\n
      • Once the Claim has been assigned, you may not pursue the claim directly or via another agent.<\/span><\/li>\n
      • Any compensation paid directly to you is deemed held <\/span>in trust for Fly Reclaim<\/b>, and our Fee remains payable.<\/span><\/li>\n<\/ul>\n

        4. Client Obligations<\/b><\/h3>\n
          \n
        • Provide complete and truthful information and documentation (tickets, boarding passes, receipts, ID where required).<\/span><\/li>\n
        • Refrain from pursuing the Claim with the airline, another company, or a lawyer while Fly Reclaim is engaged.<\/span><\/li>\n
        • Immediately inform Fly Reclaim if you receive any payment or communication from the airline relating to the Claim.<\/span><\/li>\n<\/ul>\n

          5. Fees<\/b><\/h3>\n
            \n
          • Our service is strictly <\/span>no win, no fee<\/b>.<\/span><\/li>\n
          • If no compensation is recovered, no Fee is due.<\/span><\/li>\n
          • If compensation is recovered, Fly Reclaim charges <\/span>30% (VAT included)<\/b> of the total recovered amount.<\/span><\/li>\n
          • If compensation is paid directly to you, you remain liable to pay Fly Reclaim the agreed Fee.<\/span><\/li>\n<\/ul>\n

            6. Legal Proceedings<\/b><\/h3>\n
              \n
            • Fly Reclaim may escalate claims to courts, regulators, or enforcement authorities if necessary.<\/span><\/li>\n
            • You agree to cooperate by signing additional documents (including Power of Attorney) if required for litigation.<\/span><\/li>\n
            • Fly Reclaim covers all litigation costs, unless you unilaterally withdraw or settle directly with the airline\u2014in which case the Fee remains payable.<\/span><\/li>\n<\/ul>\n
               <\/div>\n

              7. Limitation of Liability<\/b><\/h3>\n
                \n
              • Fly Reclaim will act diligently but does not guarantee successful recovery.<\/span><\/li>\n
              • We are not liable for indirect or consequential losses (missed holidays, lost time, emotional distress).<\/span><\/li>\n
              • Our liability is limited to the total Fee paid for the specific Claim.<\/span><\/li>\n<\/ul>\n
                 <\/div>\n

                8. Data Protection<\/b><\/h3>\n
                  \n
                • We process your personal data in accordance with our <\/span>Politique de Confidentialit\u00e9<\/b>, compliant with <\/span>UAE PDPL<\/b>, <\/span>EU GDPR<\/b>, and <\/span>UK GDPR<\/b>.<\/span><\/li>\n
                • Data may be shared with airlines, legal representatives, courts, and service providers solely for claim purposes.<\/span><\/li>\n
                • Sensitive data (e.g., disability or medical information) is processed only when necessary to support your claim.<\/span><\/li>\n<\/ul>\n
                   <\/div>\n

                  9. Termination<\/b><\/h3>\n
                    \n
                  • You may withdraw before signing the Assignment Form without cost.<\/span><\/li>\n
                  • Once assigned, termination is only possible by written agreement.<\/span><\/li>\n
                  • If you withdraw unilaterally after Fly Reclaim has initiated work, or if you settle directly with the airline, our Fee remains payable.<\/span><\/li>\n<\/ul>\n

                    10. Governing Law & Jurisdiction<\/b><\/h3>\n
                      \n
                    • These Terms are governed by the laws of the <\/span>United Arab Emirates<\/b>, without prejudice to mandatory consumer protection laws in your country of residence.<\/span><\/li>\n
                    • Disputes not resolved amicably shall be subject to the jurisdiction of the <\/span>Dubai International Financial Centre (DIFC) Courts<\/b>, unless mandatory local law applies.<\/span><\/li>\n<\/ul>\n
                       <\/div>\n

                      11. Miscellaneous<\/b><\/h3>\n
                        \n
                      • Fly Reclaim may amend these Terms from time to time. Updated Terms will be published on our website with a new effective date.<\/span><\/li>\n
                      • If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.<\/span><\/li>\n
                      • In the event of conflict between these Terms and the <\/span>Assignment Form<\/b>, the Assignment Form prevails regarding assignment and representation.<\/span><\/li>\n<\/ul>\n
